Angel (not his real name), a kindergartner, was accused by the School of hitting his teacher.  The principal gave the student an out-of-school suspension of 10 days.   Angel was suspended from school for three days this year for his behavior.  

Angel was entitled to a manifestation determination meeting because he has an IEP, and his removals exceeded 10 days during this school year for similar behavior.
